General Terms

We do not allow Adult, Warez, illegal MP3 Sites or IRC Bots. 

You may not store more data in your account than your allotted server space. If you go over your allotted disk space, you will be charged £25.00 per 50MB. Upgrading to the next hosting account is also an option for increasing disk space on our servers. If you are on an unlimited package, the space on the server will expand accordingly and will not be asked to pay extra charges.

Your server space and ftp account is for your personal use only. You must not divulge the password to any other person, and you should take reasonable precautions to ensure that it is not discovered by other people. If for any reason you believe someone has gained access to your password, please ensure you change it as soon as possible or contact customer support: support@cortinawebsolutions.co.uk

Data stored on our servers is not guaranteed to be backed up. It is recommended that you keep an independent backup of all data stored on your web space. 

You may not run server processes (eg. talkers/IRC Bots) from your web space.

We shall not be held liable for any loss or damages caused by the use or misuse, unavailability or removal of services. 

When your account is closed, all files (including web pages, etc.) will be deleted. 

We reserve the right to cancel your account at any time without notice. 

We reserve the right to amend and update these Terms and Conditions at any time without notice. 


To protect your privacy we never distribute your name or e-mail address to any third parties. 

Users must not participate in any form of un-solicited bulk e-mailing or spam. Detection of this will result in closure of your account. Partial refunds for any remaining time on your subscription of accounts or services will not be given.

By logging into your account, or uploading files to it, you are indicating your acceptance of these Terms and Conditions.


Bandwidth

Cortina Web Solutions operates a fair use policy and therefore offers unrestricted use of bandwidth. However, should your bandwidth reach the points where it has an adverse affect on other clients we reserve the right to disable your site until you can reduce your bandwidth usage. Web Pages

Commercial use of web and ftp space is permitted. 

You will be responsible for the content of your pages, including obtaining the legal permission for any works they include and ensuring that the contents of these pages do not violate UK law. 

You will be held responsible for and accept responsibility for any defamatory, confidential, secret or other proprietary material available via your page(s). 

We reserve the right to remove material deemed inappropriate from your web pages, without prior notice. Cortina Web Solutions do not allow adult, warez or illegal MP3 web sites on their servers. 


Cancellation and Refunds

If you take out one of yearly packages we expect you to commit for this period of time. Because of your commitment, we offer a discount on the normal monthly price of our accounts. If you cancel your account within your service period then Cortina Web Solutions will not make any refunds on any unused portions of your account. While we do not offer refunds for pro-rated service (beyond our 30 day money back guarantee which is applicable to annual accounts only) you have no obligation to continue using our service. 

Our 14 day money back guarantee (applicable to annual accounts only) excludes the refund of domain name registration fees, secure server certificate purchases and the purchase of our dedicated software required for your particular business and web service needs that were necessary as part of your account registration.

Cortina Web Solutions reserves the right to cancel the service at any time. Customer refund requests are to be sent to support@cortinawebsolutions.co.uk and will only be processed in the cases of service non-performance where Cortina Web Solutions is clearly at fault. Refund requests for problems beyond Cortina Web Solutions control will be refused.

For example: 
Domain transfer failure. 

Failure of any third party script or program that's not supported by Cortina Web Solutions. 

A customer's lack of experience in dealing with web basics and communication protocols. 

Indemnification

Customer agrees that it shall defend, indemnify, save and hold Cortina Web Solutions harmless from any and all demands, liabilities, losses, costs and claims, including reasonable solicitors fees asserted against Cortina Web Solutions, its agents, its customers, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by customer, its agents, employees or assigns. Customer agrees to defend, indemnify and hold harmless Cortina Web Solutions against liabilities arising out of:

(1) any injury to person or property caused by any products sold or otherwise distributed in connection with Cortina Web Solutions server.
(2) any material supplied by customer infringing or allegedly infringing on the proprietary rights of a third party.
(3) copyright infringement.
(4) any defective products sold to customer from Cortina Web Solutions server. 

Disclaimer

Cortina Web Solutions will not be responsible for any damages your business may suffer, Cortina Web Solutions makes no warranties of any kind, expressed or implied for services we provide. Cortina Web Solutions disclaims any warrantor merchantability or fitness for a particular purpose. This includes loss of data resulting from delays, non-deliveries, wrong delivery, viruses and any and all service interruptions caused by Cortina Web Solutions and its employees.

Cortina Web Solutions reserves the right to revise the above terms and conditions at any time.
